Constitutional challenge mounted against incineration

he Sala IV constitutional court has admitted for study an appeal against a government decree that permits the construction of trash incinerators.

Environmental sources said the appeal was presented by the Asociación de Desarrollo Residencial Ciudad Cariari and individuals.

The decree being appealed came out last June 15. As is typical, the Sala IV suspends the decree until a decision is reached.

Firms have plans to install incinerators in Carrilo, el Coyol, La Uruca, Tilarán, Bagaces,  Parrita, Atenas, Pavas, Mora and La Carpio.

In addition to reducing garbage to ash, some of the designs would use the heat to generate electricity.

Many who oppose incineration prefer that the public recycle and reduce consumption.

The appeal states that incineration would generate greenhouse gases and reduces the need for an integral handling of trash, meaning recycling. There also are challenges to technical aspects of the decree, including the establishment of buffer zones.
